Terms of Service

These Terms of Service ("Terms") govern your access to and use of AspiTalks, a social audio platform developed and operated by AspiLabs ("we", "us", or "our"). AspiTalks allows users to join live audio rooms, have one-to-one voice conversations, and connect with communities around shared interests.

1. Acceptance of Terms

By accessing or using AspiTalks, you confirm that you are at least 18 years of age (or 13 years of age with parental consent where applicable), that you have read and understood these Terms, and that you agree to be legally bound by them. If you are using AspiTalks on behalf of an organization, you agree to these Terms on behalf of that organization.

2. Description of Service

AspiTalks provides a live social audio platform that includes:

• 🎙️ Group Audio Rooms — Open, topic-based voice rooms where multiple users can speak and listen.
• 📞 One-to-One Calls — Private, real-time voice conversations between two users.
• 👤 User Profiles — Personalised profiles with display names, bio, and social stats.
• 🔔 Notifications — Push notifications for room activity, follows, and messages.
• 💬 Direct Messages — Private text-based messaging between connected users.

We reserve the right to add, modify, or discontinue features of the service at any time with or without notice.

3. Account Registration

To use AspiTalks, you must sign in using Google Sign-In. By signing in, you authorize us to access certain Google account information (name, email, profile picture) as described in our Privacy Policy. You are responsible for maintaining the confidentiality of your account and for all activities that occur under your account.

4. User Conduct

AspiTalks is built for authentic, respectful conversation. You agree NOT to use the platform to:

• 🚫 Harass, abuse, threaten, or intimidate other users
• 🚫 Share hate speech, discriminatory content, or content that incites violence
• 🚫 Post or share sexually explicit or pornographic material
• 🚫 Exploit, harm, or endanger minors in any way (zero-tolerance CSAM policy)
• 🚫 Impersonate any person, entity, or misrepresent your affiliation
• 🚫 Spam, advertise, or promote unsolicited products or services
• 🚫 Spread misinformation, fake news, or deliberately misleading content
• 🚫 Use bots, scripts, or automated tools to interact with the service
• 🚫 Attempt to hack, reverse-engineer, or disrupt the platform or its servers
• 🚫 Violate any applicable local, national, or international law or regulation

5. Audio Room Rules

AspiTalks audio rooms are public or semi-public spaces. When participating in a room, you agree to:

• ✅ Respect the room's topic and the host's direction
• ✅ Allow other speakers to finish before speaking
• ✅ Not record, capture, or distribute audio from any room without explicit consent from all participants
• ✅ Follow host instructions — hosts have the right to mute or remove participants

AspiTalks does not record or store audio from rooms. However, we may take action based on reported conduct.

6. Content and Intellectual Property

Any content you share on AspiTalks (profile information, text messages, room titles, etc.) remains your property. However, by sharing it, you grant AspiTalks a non-exclusive, royalty-free, worldwide license to use, display, and distribute that content solely for the purpose of operating the service.

The AspiTalks platform, logo, name, design, and all related intellectual property are owned exclusively by AspiLabs. You may not copy, reproduce, or use these without our prior written consent.

7. Content Moderation

AspiTalks uses a combination of AI-powered moderation (Google Gemini) and human review to detect and remove content that violates these Terms. We reserve the right to remove any content, warn, suspend, or permanently ban any user who violates our community guidelines without prior notice.

8. Third-Party Services

AspiTalks uses the following third-party services to operate. By using AspiTalks, you also agree to their respective terms:

• 🔥 Google Firebase — Authentication, database, and cloud storage
• 🎙️ LiveKit — Real-time audio infrastructure
• 📢 Google AdMob — In-app advertising (future versions)

9. Disclaimer of Warranties

AspiTalks is provided on an "as is" and "as available" basis without any warranties of any kind, express or implied. We do not guarantee that the service will be uninterrupted, error-free, or completely secure. AspiTalks is not responsible for the accuracy, completeness, or appropriateness of any user-generated content shared on the platform.

AspiTalks is an independent, privately developed platform. It is NOT affiliated with, endorsed by, or representative of any government body or public authority. Any government exam information discussed within the app is for community discussion purposes only.

10. Limitation of Liability

To the maximum extent permitted by applicable law, AspiLabs shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. This includes, but is not limited to, any loss of data, revenue, or goodwill. Our total liability for any claim related to the service shall not exceed ₹1,000 INR (or its equivalent).

11. Termination

We reserve the right to suspend or permanently terminate your account at any time, without prior notice or liability, for any of the following reasons:

• Violation of these Terms of Service
• Conduct that is harmful to other users or to the platform
• Fraudulent, abusive, or illegal activity
• At our sole discretion, for operational or legal reasons

Upon termination, your right to use the service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in India.

13. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we do, we will update the "Last Updated" date at the top of this page. For significant changes, we will make reasonable efforts to notify users in advance through the app or email. Your continued use of AspiTalks after changes take effect constitutes your acceptance of the revised Terms.
